| Can anyone sale a plant or only professional nurserys? |

| From the perspective of the auction site anyone can sell...however the state of Texas may have other thoughts. Each state has their own rules so before you start selling I'd definitely find out if TX has any rules or restrictions (like having to have a nursery license). |

| every state and every common carrier (UPS, USPS,etc) in the US requires that plant shipments have an AG Tag. some states are more restrictive (i.e. CA, WA, OR) and require either plants to come from a greenhouse with soil-less potting mix or that all soil (and traces thereof - think sink clean) are removed prior to shipping.

| Thanks Guys I emailed the agri. control in Texas. I am going to need to move to another state to be able to sale. I still can't figure out how Tex. nurserys can afford to sale on ebay if all their shipments cost $30.00 for an inspection. That is what the National Plant Board charges. |

| And they probably don't have to pay $30 for every single shipment, most likely they gather up all their shipments for the week and have the inspector look at them at one time. Systems like that are not friendly to people who just want to sell a little bit of stuff once in a while, but for someone who makes their living selling things and has plants going out all the time it's more reasonable. |

| Mine always have stamps, phyto certs, etc, but I order from mail order nurseries not typically individual people on Ebay (even the things I have got from Ebay were from people who ran small nurseries) California's picky about what plants can come in, I think if I ordered something and they realized it was plants and it didn't have the proper stamps and inspections they'd probably throw it out. |

| I order from mail order, too, and AZ is also very picky, I think AZ and CA are 2 of the most picky, still no stamps on mine. |

| i don't get it, usually you only have physo cert. from other countries, why would you have to have anything like that to sell here in the usa?

| No, you need them to ship plants from one state to another as well. Different states have different requirements, and some are stricter than others but I think most of them probably require some sort of phyto certificates. |

| My guess is you've probably shipped something somewhere that you were supposed to have certificates and you just didn't get caught. I have a feeling for smaller scale operations it's probably not that hard to do things "under the radar" and not get caught most of the time. There may be some states that would accept things from IL without any certificates or inspections, but I guarantee there are states out there that you're supposed to have certificates before you ship there. The trouble is that the onus is on you to understand your state's rules on selling plants, and also the rules of the state you're shipping to on what their requirements are (some need certificates, some may want you to bare-root your plants, etc), but you have to go looking for the rules and most people probably don't bother to do that. And the ag inspectors have bigger fish to fry, so you might be able to fly under the radar for a long time without getting caught (but I'm not sure what the consequences are if they do eventually find out that you've been doing stuff without following the rules.) |

| alot of times when i would go to the post office to ship plants from an ebay sale, they would ask what was in the box & i would say a plant,they never offered to look to see if that state had any restrictions & i don't think it's because they were to lazy, but you would think they would as they do when i ship out of the country. i just don't get it.but tommorro i will definately call the post office & find out.

| I don't think it's part of the post office's job description to know about (or enforce) rules regarding interstate transport of plants. Your state's ag department would be a much better place to look for the rules. |

| Just a little - I did a lot of Iris, veggies - no problems there... Natives - no problem there, but my tropicals well those all moved with me and we will see what I will end up doing to get them growing. |
