I would - it won't hurt anything, anyway. It looks like an Orchard orb weaver, but it's hard to be sure. See what you think:

claypa~thank you for your response, checked out your link, not sure its the same spider. The ones in your link have a much rounder body. And the web my spider weaves is pretty intricate, more like a widow, than a regular spider.
Sorry my picture is not clearer, it is a pretty small spider. |
